Kapil Sibal's "Indira Gandhi" Response to Dhankhar's Comment

NEW DELHI: Vice President Jagdeep Dhankhar's recent criticisms of the judiciary have sparked a strong rebuttal from senior advocate and Rajya Sabha MP Kapil Sibal. Dhankhar contended that the Supreme Court is overstepping its authority by invoking Article 142, describing it as a "nuclear missile" against democratic forces. His remarks followed a Supreme Court ruling mandating that the President decide on bills reserved by the governor within three months. Sibal countered by recalling a 1975 Supreme Court decision that unseated then Prime Minister Indira Gandhi, questioning why Dhankhar accepted that ruling but challenges a recent two-judge bench decision. Sibal expressed dismay at Dhankhar's public criticism of the judiciary, emphasizing its trustworthiness and the President's role as a titular head acting on Cabinet advice. He accused Dhankhar of undermining judicial independence and constitutional understanding, asserting that the judiciary's authority must be respected. sources

Supreme Court Calls UP 'Dishonour Killing' Total Murder

The Supreme Court of India has ordered that murder charges be framed against a family involved in a dishonour killing in Uttar Pradesh, overruling previous decisions to charge them with the lesser offence of culpable homicide not amounting to murder. Chief Justice Sanjiv Khanna expressed astonishment at the trial court's decision, which was based on the absence of firearms and a perceived lack of intent. The case involves the brutal death of 26-year-old Zia-ur Rahman, who was attacked with iron rods and wooden sticks by the family of his partner, who belonged to a different faith. The Supreme Court directed the Uttar Pradesh chief secretary to appoint a special public prosecutor to handle the case, while allowing the accused family members to seek fresh bail pending the outcome of the new charges. The high court had previously rejected a plea from Rahman's father, Ayyub Ali, to escalate the charges. sources

NDTV Explains: Ex-Spy Chief's Shocking Claim on Abdullahs' Relations

Explosive revelations in AS Dulat's memoir, *The Chief Minister and the Spy*, have ignited a political firestorm in Jammu and Kashmir, particularly involving National Conference leaders Farooq and Omar Abdullah and People's Democratic Party chief Mehbooba Mufti. Dulat alleges that Farooq Abdullah "privately supported" the abrogation of Article 370, a claim the 87-year-old Abdullah vehemently denies, calling it a "cheap stunt" to boost book sales. He argues that both he and Omar were detained during the 2019 constitutional changes, contradicting any notion of consent. Mufti, meanwhile, accused the National Conference of seeking power at any cost and alleged that Omar approached Union Home Minister Amit Shah in 2014 for support. In response, Omar dismissed Mufti's comments as baseless and criticized Dulat's tendency to exaggerate. Dulat, for his part, defended his book as largely complimentary towards Farooq Abdullah, claiming his words were misinterpreted. sources

Am I Truly Indian? - Derek O'Brien

The Waqf Amendment Bill, 2024, titled "Umeed," has sparked significant concern regarding its implications for religious equality and minority rights in India. The Bill introduces a five-year requirement for Muslims to practice Islam before establishing a Waqf, a condition not imposed on other religious groups, raising questions about discrimination and the violation of the Right to Equality. Additionally, it removes the concept of "Waqf by user," undermining the rights of Muslim institutions while allowing similar protections for Hindu and Christian entities. The Bill also alters the composition of Waqf Boards to include a majority of non-Muslims, undermining the autonomy of these bodies, and centralizes power with government officials to determine Waqf status, violating principles of natural justice. Critics argue that the Bill threatens federalism and personal autonomy, highlighting a troubling shift in how belonging and faith are legislated in India. The Supreme Court is currently reviewing the Bill's constitutional validity. sources
